From the guidance you will note many exclusions, exceptions and interpretation is required and in reality, hurdles have to be jumped to obtain a successful refund.
The procedure is commonplace for professionals and while an amateur may put in a refund request, if it has not been presented properly or indeed the major factors have been overlooked, its likel the claim will be rejected. Few if any professionals will pick up a failed DIY claim.
What the HMRC do accept
Within HMRC guidance they readily accept issues of safety for occupants.
For example, HMRC identify asbestos and radioactive pollution as just two areas that can be considered eligible for stamp duty refund.
While you might not want either of these contaminates to be present, they could be , but more importantly there are other contaminates more likely present that no usual RICS or building surveyor would identify.
Another caveat that HMRC identify is that the pollutant cannot be rectified quickly. The issues we identify are complex and will most likely comply with HMRC requirements.
